HC directives in plea againest order on ReT scheame


JAMMU: Vacation Judge of J&K High Court Jammu Wing Justice Sindu Sharma on Friday directed the respondents that subject to objections and till next date of hearing, Clause (ii) of Government Order No.919-Edu of 2018 dated November 16, 2018 shall not come in the way of consideration of petitioners’ claim in issuing the appointment orders, if any.
The courts
After hearing advocates appearing for the petitioners, the court observed that contention of the petitioners is that Clause (ii) would not govern their cases since the petitioners’ selection has been concluded after adjudication of their claim by this Court.
Court further observed that petitioners have submitted that this Court has already passed the interim directions in SWP No.2673/2018 on December 7, 2018 and that the petitioners are similarly situated as the petitioners in aforesaid SWP, therefore, seeking the similar relief.
After hearing Advocates in length, Court issued notices to the respondents in the main petition as well as Interlocutory Application, returnable within four weeks. It was directed to serve the notices within one week
direction came after considering bunch of petitions challenging Clause (ii) of Government Order No.919-Edu of 2018 dated November 16, 2018 whereby all advertisement notices for engagement of Rehbar-e-Taleem (ReT) Teachers or panels prepared where no engagement orders were issued shall and shall always be deemed to have been cancelled / withdrawn as ab-initio.
